Florida Dog Attack Leaves Small Dog Injured

Dog attacks are dangerous, especially for smaller animals and children. In many of these situations, victims are seriously injured or even killed.

A recent attack in Florida has left a dog seriously injured. A pitbull mix attacked a small Havanese-poodle mix in Miami Gardens on the morning of January 26. The unprovoked dog attack happened in the area of Northwest 205th Street and 45th Avenue.

A woman was walking her small dog in the area when she came upon a neighbor walking her pitbull mix. She had seen both before. The pitbull mix suddenly charged at her dog, breaking free. The pitbull’s owner fell while trying to restrain the dog. The pitbull clamped onto the smaller dog’s stomach.

The dog and their owners were screaming and howling. Finally, a man came down the street and hit the pitbull with the handle of a machete. That was when the larger dog loosened his grip on the smaller canine.

While the owner of the smaller dog suffered some bites and bruises on her hand in the attack, her dog had it far worse. Her stomach was ripped open and she was bleeding everywhere.

The smaller dog spent nearly a week at LeadER Animal Specialty Hospital in Cooper City. She is now at home recovering from her injuries. She is now starting to eat and drink like normal.

The pitbull was placed on a 10-day quarantine by Miami-Dade Animal Services. However, the owner still walks the dog daily as if nothing had happened. The owner of the Havanese-poodle mix is upset that more was not done to punish the dog’s owner.

She is scared to be out in her own neighborhood. The attack on her dog has made her feel unsafe, especially since the pitbull is still out on the streets. She hopes her neighbors will be cautious, as if it happens again, it could cause someone to get killed.

Strict Liability in Florida

In Florida, dog bite injuries are governed under strict liability. This means that the victim does not need to prove negligence, which is the case in other areas of law. Under strict liability, it does not matter if the dog’s owner was careful. It does not matter if the dog had bitten before or if the dog was generally a nice dog. If the dog bites for any reason, the owner is responsible.

In Florida, dogs don’t get “one free bite.” The owner is responsible for any damage done, starting with the first bite.
